The Criminal-Legal Analysis of the Offence of Inducing or Aiding Suicide – Article 150 of the Criminal Code of the Republic of Moldova. Summary of the Doctoral Thesis in Law

Abstract

Topicality and importance of the subject addressed. Article 3 of the Universal Declaration of Human Rights proclaims that: “Every human being has the right to life, liberty and security of person”1, while the Convention for the Protection of Human Rights and Fundamental Freedoms protects the right to life under Article 2(1) – Right to life, through the following stipulation: “Everyone’s right to life shall be protected by law”2. The protection of human life as the supreme value of the legal order is enshrined at constitutional level in Article 24 – Right to life and to physical and psychological integrity of the Constitution of the Republic of Moldova3, a provision which establishes both the fundamental right to life and integrity and safeguards against any form of treatment liable to harm the dignity or integrity of the person, thereby expressing the positive obligation of the state to ensure and protect life as a legal value of supreme importance. The importance of research on the topic “The Criminal Legal Analysis of the Offence of Inducing or Facilitating Suicide – Article 150 of the Criminal Code of the Republic of Moldova” is determined by the need to strengthen the criminal law guarantees of a person’s right to life, including through the further refinement of the normative framework governing the offence set out in Article 150 CC RM Inducing or Facilitating Suicide, intended to ensure uniform and coherent judicial practice in this field. This is so because the criminalisation of inducing or facilitating suicide protects the most important social value safeguarded by criminal law, namely the right to life.
